Mobile Application Terms and Conditions

BOTDOC MOBILE APP TERMS AND CONDITIONS

These Botdoc Mobile App Terms and Conditions (these “Mobile TOS”) are between ShortSave, Inc., a Colorado corporation doing business as Botdoc (“Company,” “Us”), and the individual or organization agreeing to these Mobile TOS as set forth below (“Customer,” “You”). As a condition of Customer’s use of and access to the botdoc.io website, the Botdoc service, the Botdoc mobile application, and any related software (collectively, the “Services”), Customer agrees as follows.

These Mobile TOS supplement, and do not replace, the Botdoc Corporate Terms of Service at https://botdoc.io/corporate-terms-of-service/ and the Botdoc User Terms of Service at https://botdoc.io/user-terms-of-service/, as applicable to you. In the event of any conflict between these Mobile TOS and either of the foregoing agreements, the Corporate Terms of Service or User Terms of Service controls, except with respect to the SMS-specific provisions set forth in Sections 2 through 6 below.

Definitions

For the purposes of these Mobile TOS:

  • “Application” means the software program provided by the Company and downloaded by You on any Device, named Botdoc.
  • “Company” (referred to as either “the Company,” “We,” “Us,” or “Our”) refers to ShortSave, Inc., d/b/a Botdoc.
  • “Device” means any device that can access the Service, such as a computer, cell phone, or tablet.
  • “Service” refers to the Botdoc service.
  • “Mobile TOS” mean these Mobile App Terms and Conditions.
  • “Website” refers to Botdoc, accessible at https://botdoc.io.
  • “You” or “Customer” means the individual accessing or using the Service, or the organization on whose behalf such individual is accessing or using the Service.

Acknowledgment

These Mobile TOS govern Your use of the Botdoc mobile application and the SMS-based components of the Service and form an agreement between You and the Company.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Mobile TOS. Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Botdoc Corporate Terms of Service or User Terms of Service (as applicable to you) and the Botdoc Privacy Policy and Acceptable Use Policy.

By accessing or using the Service, You agree to be bound by these Mobile TOS. If You do not agree, You may not access or use the Service.

1. Program Description

The Secure Digital Transport program, powered by Botdoc, enables customers to securely engage with businesses such as banks, lenders, financial advisors, automotive dealerships, healthcare providers, and other organizations. Users interact with Botdoc’s technology by sending prefilled text messages and receiving secure, customized responses. Each interaction is initiated by the recipient and is a one-time, one-for-one communication: send a message, receive a message with further instructions or with a link to the requested digital transport.

2. Consent to SMS Messaging

By providing Your mobile phone number to Botdoc through the Service or to a Botdoc customer that uses the Service to send You a request, You expressly consent to receive SMS text messages from Botdoc and from Botdoc customers using Botdoc’s technology, in connection with the Service. The frequency of messages is described in Section 6 below. Your consent is not a condition of any purchase. Message and data rates may apply as described in Section 5.

If You did not provide Your mobile phone number for the purpose of receiving SMS messages from Botdoc or a Botdoc customer using the Service, do not respond to the message; reply STOP to opt out, as described in Section 3.

3. Opt-Out (STOP)

You can cancel SMS messaging at any time. Just reply “STOP” to any message from us or to the short code from which You receive Botdoc messages. After You send “STOP,” You will receive a one-time confirmation message that You have been unsubscribed from that program. After that, You will no longer receive SMS messages from us through that program. To rejoin, You may sign up again as You did originally; opting in again from any Botdoc-enabled organization will resume SMS messaging from that organization.

4. Support and HELP Keyword

If You are experiencing issues with the messaging program, reply with the keyword “HELP” for assistance. You will receive a one-time response with support contact information. You can also contact our support team directly at support@botdoc.io.

5. Carrier Liability and Message & Data Rates

Carriers are not liable for delayed or undelivered messages.

Message and data rates may apply for messages sent to You from Us and to Us from You. If You have questions about Your text or data plan, please contact Your wireless provider. Botdoc does not charge a fee for SMS messages; any charges are between You and Your wireless carrier.

6. Message Frequency

You will receive one (1) message per request initiated by You or by a Botdoc customer that has obtained Your consent. Each SMS interaction is a one-time reply or a request for confirmation. Messages are not sent on a recurring or scheduled basis.

7. Privacy

For details on how Botdoc collects, uses, and protects Your data, please review the Botdoc Privacy Policy. Botdoc does not share or sell Your information to third parties for marketing purposes.

8. Required Consents (Customer-Sender Obligations)

If You are a Botdoc customer (a “Sender”) using the Service to send SMS messages to a recipient, You represent and warrant that, prior to using the Service to transmit any SMS to that recipient, You have obtained the recipient’s prior express consent (and, where required by applicable law, prior express written consent) to receive such messages, in compliance with the Telephone Consumer Protection Act, the CAN-SPAM Act, and any applicable state-law equivalents. Botdoc relies on this representation. Any breach of this Section 8 by a Sender may result in suspension or termination of the Sender’s Botdoc account in accordance with the Botdoc Corporate Terms of Service or User Terms of Service, as applicable.

9. Changes to These Mobile TOS

Botdoc may modify these Mobile TOS from time to time. For material changes, Botdoc will provide at least thirty (30) days’ advance notice to You by SMS, by email to the address associated with Your Botdoc account (if any), or by posting at https://botdoc.io/policy-mobile-terms-of-service/. “Material change” means a change that materially decreases Your rights or materially increases Your obligations or financial commitments. By continuing to access or use the Service after the effective date of an update, You agree to be bound by the revised Mobile TOS. If You do not agree, You may stop using the Service and reply STOP to opt out of SMS messages.
